摘要
《张家山汉简.二年律令》是吕后二年的律令,它使我们看到了久已佚失的汉律的部分真相。这使得将其与传世文献的记载进行比较研究成为可能。以汉唐两律为代表的中国古代刑法有关杀人罪的规定有其自身特点。通过《二年律令》与《唐律疏议》的比较,可以发现《二年律令》中"谋杀"的构成要件同样为预谋而非人数。对于造意者,即使没有实际参与杀人行为也不妨碍他的主谋身份。而仅参与谋划的人作为共犯,其处刑和实行犯是一样的。
<Er Nian Lü Ling(the Second Year Laws)> are about the law of Han dynasty.They make it possible for us to see what is the law of Han dynasty and then to verify the record in history book.In ancient times of China,the law of homicide has its own character.Comparing the law of homicide in <Er Nian Lü Ling> and <Tang Lu Shu Yi(the Code and its Interpretations of Tang Dynasty)>,we can find that so called 'the designing between two men' is just a form of intent.It emphasized the intent,but not two men.So intent is also a necessary condition in a murder in <Er Nian Lü Ling>.The head of a conspiracy must be sentenced to death even if he may not kill a person by himself.And the one who had taken part in the designing will accept the same punishment as the killer.
