摘要
知识产权法有促进竞争的一面,但与竞争又不可避免地存在内在冲突。竞争法对知识产权具有“抑”与“扬”的双重功效,既能有效地保护知识产权,又对知识产权领域中的不正当竞争行为加以规制。在协调知识产权法与竞争法的关系时,竞争法应对行使知识产权的正当行为予以豁免,对不正当行为予以约束。
Intellect Property Law may promote and conflict with competition. Competition Law may, on one hand, protect intellect property and, on the other hand, stipulate and restrict illegitimate competition in the field of intellect property. Therefore, competition law should exempt reasonable act in exercising intellect property rights and restrict the illegitimate
