摘要
由于近年来二手房交易的迅猛增长,导致涉及承租人优先购买权制度的纠纷与矛盾日益凸现。作为民法体系中一项相当重要的规则,承祖人优先购买权制度在我国多部法律法规中均有规定。本文对这一制度的基本理论进行了梳理.并在此基础上对理论与实践中争议较多的若干问题作了探讨。在文中,笔者还适时地提出了自己的观点,包括一些在法律条文上对该制度进一步规范的建议,以期在保障自愿原则的前提下,起到节约交易成本、稳定经济秩序、促进社会和谐的良好效果。
The boost in the transaction of second-hand real estate has resulted in increasing dissensions and conflicts involving the regulations about the lessee's preemption. An important part in the system of civil law, the system of the lessee's preemption is prescribed in a few laws of our country. This article presents a meticulous analysis in the basic theories of the system, and discusses several controversial issues in both academia and practice. The author's viewpoints are also presented, which include a few proposals that intend to save the cost of exchange, stabilize the economic order and promote social harmony while guaranteeing the principle of voluntari-ness.
