摘要
行刑社会化源于西方国家的监狱改良运动,被作为人类文明成果介绍到中国,引起学界和实务界的极大推崇。毋庸讳言,行刑社会化这一制度设计凭借其自身的独特优势颠覆了传统监禁刑的理论与实践,具备积极革新的基因,然而任何一项制度的存在和发展,都必须依托于一定的时间、空间及物质、精神等诸多层面。当下我国的现状是否会对行刑社会化的移植产生排异反应,应该得到足够的探讨和关注,这也是其本土化的必然进路。
