摘要
仲裁条款是合同的一项条款,存在的目的是为了解决主合同的相关争议。但仲裁协议又独立于合同,不因合同不成立、终止、无效、变更、转让而失去效力。仲裁条款的独立性有理论和现实的依据。仲裁条款有效与否,关键在于其是否满足了自身的有效要件,而与合同的效力和改变没有因果关系。
On one hand,the arbitration clauses are clauses of the contract for solving the relating disputation.On the other hand,the arbitration clauses are autonomic which will not void when the contract is ineffective,void,ending or changing.The effectiveness of the arbitration clauses depends on whether or not they meet its own elements of an effective,does not depend on the effectiveness of the contract.
