摘要
论证了行政失职概念的合理性，阐述了行政失职概念的内涵，指出行政失职以行政主体负有法定的行政作为义务为条件，其本质特征是行政主体对法定作为义务的违反。
This paper argues the rationality of the concept of administrative misfeasance， and elaborates the connotation of the concept. The author points out that it is a precondition of administrative misfeasance that an administrative subject assume the legal obligation to perform an administrative act, its essential feature is that administrative subject disobeys a legal obligation of act.
