摘要
通过将欧盟、北美自由贸易区、世界贸易组织、东盟自由贸易区等各具代表性的争端解决机制与中国—东盟争端解决机制进行比较研究,归纳出中国—东盟争端解决机制的特征:中国—东盟争端解决机制与北美自由贸易区和世界贸易组织的准司法性争端解决机制相类似,甚至在某些具体规定上还借鉴了世界贸易组织的争端解决机制。
This article sums up the characteristics of the dispute settlement mechanism of China-ASEAN countries through a comparative study of the European Union,the North American Free Trade Area,World Trade Organization and ASEAN Free Trade Area.They are similar to the quasi-justice dispute settlement systems of NAFTA and WTO,with some provisions borrowing ideas from the WTO Dispute Settlement Mechanism.
