摘要
本文结合商标权与企业名称权的相互关系和我国的立法现状 ,重点分析了造成商标权与企业名称权冲突的主要原因 ,并通过对我国解决两权冲突的现行办法及存在问题的剖析 。
This article analyses main reasons for the con flict between trademar k right and the right of the exclusive use of enterprise names in the light of t he relationship between them and the current relevant legislation in our country and discusses how to resolve the conflict by analyzing the current provision s for resolving the conflict in our country and the existing problems in this re spect.
