摘要
农地所有权制度是农村土地制度的核心。我国目前的农地所有权制度存在许多缺失和不足,成为解决三农问题的一个主要障碍,理论界为此提出了许多的改革方案。我们应该在全面考虑农地所有权制度变革的收益成本、路径依赖、农民的心理、社会公平和稳定等因素基础上来理性构建我国农地所有权制度。在坚持农地集体所有权制度的前提下,明确权利的主体,充实权能,分清国家所有权与集体所有权的界线。
The system of agricultural land ownership is the core of the rural land system.At present,many flaws and shortcomings exist in our country's current system of agricultural land ownership,which becomes a main obstacle in solving agricultural problems.Thus,theorists have put forth many reform programs.It is necessary to rebuild it rationally on the basis of considering such factors as benefits and costs of reforming system of agricultural land ownership,economic reactions and farmer psychology,social equity and stability.Namely,based on the premise of upholding the system of agricultural land ownership,we should explicit the right subject,enrich capacity and differentiate boundaries between national ownership and collective ownership.
