摘要
所谓刑法的引导性文化品格,是指刑法应有的对人的行为起引导作用的文化特性。它使刑法具有引导性、文化性、人文性和自主性等特征。从人本法律观出发,为了弘扬刑法的人文精神、实践刑事法治和彰显刑法的人权保障机能,在我国必须塑造刑法的引导性文化品格。在没有宗教赋予法律以神圣性,且过分强调宗教与法律分离的我国社会,只能依靠具体的法律实践来塑造刑法的引导性文化品格。在刑事立法层面,在追求对先进制度移植的同时,应当力求对传统优良刑法文化进行吸纳,并应突出个人法益在刑法法益体系中的地位;在刑事司法层面,通过司法改革,确立司法权的独立地位和公开状态;在法制宣传层面,从广度和深度上都应当有所推进。
