摘要
本文为解决受赠人和债权人利益的保护问题,创造性的将赠与合同分为三类,并建议引入公证公告制度以使受赠人和债权人的利益都得以兼顾,并就此加以论述。
To solve the interests protection problem for donee and creditor, this paper has creatively divided Contract Law in donating into three categories, proposed and introduced the system of certification and announcement so that the interests of donee and creditor can be given consideration. The paper will analyze this point.
