摘要
调处制度是中国古代特有的一种纠纷解决方式。它具体分为为邻里亲朋调处、宗族调处、乡治调处和诉讼调处等形式。调处制度存在的原因为无讼思想的影响、礼仪文化的熏陶、限讼与禁讼以及司法自身缺陷的现实存在。
Mediation system of the Ancient China is a unique way of settling disputes. It is specifically divided into mediation of neighborhood relatives and friends,patriarchal clan mediation,the township governmental mediation,the proceedings mediation and so on. The reason for the existence of mediation system is the impact of non-disputing thought,the influence of culture and etiquette,limited lawsuit and forbidden litigation,and the existence of judicial own flaw.
