摘要
西方形式主义司法有其独特的文化成因,根源于实证主义法学,判例法、法典化及司法的困难促进了司法的形式主义。中外形式主义司法在解决纠纷中有着不同的作用机理,西方的形式主义对我国司法的改造有重大启示。
Western formalism justice has unique cultural causes,which is rooted from positivism law.Case law,codification and the difficulty of justice improve the formalism.Chinese and foreign formalism justice has different mechanism in settling disputes.Chinese justice reform can learn a lot from western formalism.
