摘要
国际立法主要指《联合国宪章》下编纂和逐渐发展国际法的活动,对于"百年未遇之大变局"中推进构建人类命运共同体的全球治理法治化不可或缺。在人类命运共同体视野下,以联合国国际法委员会晚近专题为重点分析国际立法与人类命运共同体的关系以及实际意义或影响,有助于认识具体的国际立法与基于国家主权的人类命运共同体构建之间存在的某些冲突,进而回顾和反思中国在联合国国际法委员会有关国际立法中的积极作用和存在的不足,以便以更加积极的姿态提高参与度,切实推进人类命运共同体的国际法构建。
International legislation mainly refers the codification and progressive development of international law under the UN Charter, and it is a necessary approach to promote the rule of law for global governance in the course of the building of the human community with a shared future, which is a profound change unseen for a century. Under the perspective of human community with a shared future, this paper focuses on the recent topics under the consideration of International Law Commission to analyze the relationship between international legislation and human community with a shared future, as well as its practical meanings and influences. This research will help to understand some conflicts between certain international legislation and the notion of human community with a shared future, and to review and reflect China’s positive role for international legislation of the ILC and the existing problems. The object of this research is to further promote China’s active participations in the international legislation and to advance a concreted building of the human community with a shared future.
