摘要
公共审议或民主协商是国家治理中的必要组成部分,但人们通常认为审议的公共性和有效性主要来自广泛的政治参与,以及与之相关的对个人和社会行动主体(相对于政府)的权力扩散。这一思路导致以政治代表为主要表现形式的政治权威被想当然地看作公共审议的对立面,以至于有很多人认为政治权威与公共审议构成一种天然的此消彼长的关系。本文认为,这是一个误解,无论是当代中国国家治理的经验,还是西方国家中的代议政治实践,都可以证明,政治代表是现代民主政治得以维持一定形式的有效审议、从而避免单纯由力量决定公共规则的关键要素。更为关键的是,我们亟需从理论上对政治代表内含的公共审议属性进行规范性的审思。
Public deliberation is usually considered as a very important part of state governance. Scholars often consider the public nature and the effectiveness of public deliberation depends on extensive political participationand empowerment of individual and social actors. While not denying the validity of this judgment,this paper intends to argue that this idea tends to unnecessarily pit political authority in the form of political representation against public deliberation,and thus ignore the inherent potential of public deliberation in political authority. In this regard,both Chinese experience and representative politics in western countries could provide sources for reconsideration.
