摘要
为规范桥隧危险货物通行安全管理,健全危险货物桥隧通行管理体系,对我国危险货物运输车辆通行桥隧现行法律法规进行了梳理分析。总结了危险货物运输相关法律法规对交通运输、工信、公安、应急等多个部门法律的权责分配以及桥梁、隧道通行相关管控中存在的危险货物运输相关法律法规衔接不畅、更新不及时、桥隧管理体系不明确、桥隧危险货物运输通行规则缺乏统一的管理要求以及分级分类机制、全国桥隧管理差异较大等问题。结合其他国家相关法律体系总结了经验,提出了理顺危险货物道路运输管理逻辑,明确了桥隧为安全管理节点而不是限制重点,建立健全危险货物运输相关法律法规-标准规范体系。
In order to standardize the safety management of dangerous goods passing through bridges and tunnels and perfect the management system of dangerous goods passing through bridges and tunnels,the current laws and regulations of dangerous goods vehicles passing through bridges and tunnels in China are analyzed.The distribution of rights and responsibilities of the laws and regulations related to dangerous goods transportation to the laws of many departments are summed up,such as transportation,industry and information,public security,emergency and so on,as well as the problems of the laws and regulations related to dangerous goods transportation existing in the control of bridge and tunnel passage,such as lack of smooth connection,untimely renewal,unclear management system of bridge and tunnel,lack of unified management requirements for the traffic rules of dangerous goods transportation in bridge and tunnel,classification mechanism,and great differences in the management of bridge and tunnel across the country.Based on the experience of other countries,the logic of dangerous goods transportation management by road is put forward.It makes clear that bridges and tunnels are safety management nodes rather than restrictions,the system of laws,regulations and standards related to the transportation of dangerous goods has been established and improved.
