道路交通事故痕迹特征体系构建及综合评断路径探究

摘要 道路交通事故处理中尚存在“弱勘查、强鉴定”现象,现场痕迹物证勘查不全面、鉴定意见书论证不充分,极大妨碍了事故过程重建的实现。基于交通事故痕迹鉴定实践中的相关标准,构建了道路交通事故痕迹特征体系,并提出了综合评断路径。运用实际案例,对该特征体系和评断路径进行了评价。该体系和评断路径可以帮助相关技术人员构建特征性痕迹思维,提升针对痕迹特征勘查的全面性,并为办案机关审查鉴定意见提供重要参考。 The phenomenon of“weak investigation and strong identification”still exists in the handling of road traffic accidents.Meanwhile,the on-site trace evidence investigation is not comprehensive and the identification opinion is not fully demonstrated,which greatly hinders the realization of reconstruction of accident process.Based on the relevant standards in the practice of traffic accident trace identification,a trace feature system for road traffic accidents is constructed and a comprehensive evaluation path is also proposed.The feature system and evaluation path are evaluated by practical cases.The feature system and comprehensive evaluation path can help relevant technicians to construct characteristic trace thinking,improve the comprehensiveness of trace feature investigation,and provide important reference for the investigation authority to review the identification opinion.
