摘要
关系、产权与社会秩序密切相关。以洞庭湖区湖村的土地产权为分析对象,考察关系、产权与社会秩序的演进发现,传统时期,在分置的合作性产权基础上及关系主导下形成了"关系—权利"型秩序;集体化时期,国家主导高度集中的集体产权和村落社会,形成了强制型秩序;分田到户时期,以分置的集体产权为主导,并受到关系的影响,形成了"权利—关系"型秩序。产权与社会秩序共同演进,关系与产权权利的组合可以形成四种秩序类型:关系型秩序、"关系—权利"型秩序、"权利—关系"型秩序和权利型秩序。关系、产权及社会秩序的类型,还与国家介入的性质有关。如果国家介入是干预产权,既有社会秩序会异化为强制型秩序;如果国家介入是保护和尊重产权,则可以促进既有社会秩序向着权利主导的秩序演进。随着国家对产权保护的加强,社会秩序将向着权利型秩序演进。
Relations,property rights and social order are closely related.This paper takes the land property right of Lake Village in Dongting Lake area as the analysis object,on the evolution of relations,property rights and social order,traditional period,on the basis of the separated cooperative property rights,under the guidance of relationship,the order of“relationship-right”is formed;collectivization period,state led highly centralized collective property rights and village society,a compulsory order has been formed;the period of dividing farmland to household,dominated by decentralized collective property rights,and affected by the relationship,a“right-relationship”order has been formed.The coevolution of property rights and social order,the combination of relationship and property rights can form four types of order:relational order,“Relationship-right”type order,“Right-relation”type order and right based order.Relations,property rights and types of social order are also related to the nature of state intervention.If state intervention is interference in property rights,the existing social order will be alienated into compulsory order;if state intervention is to protect and respect property rights,it can promote the evolution of the existing social order to the order dominated by rights.With the strengthening of the protection of property rights,the social order will evolve towards the right order.
