摘要
人民法院制定发布的会议纪要属于司法指导性文件,根据规定只能用于帮助法官论证裁判理由。但对《全国法院破产审判工作会议纪要》《全国法院民商事审判工作会议纪要》等文件在司法实践中的功能分析表明,法院会议纪要实际上已经成为法官司法的重要裁判依据。法院会议纪要的实际功能与规范地位之间,出现了一定程度的背离。这主要是由立法的抽象性和滞后性、司法内部权力架构的行政性以及会议纪要内容的现实性造成的。实际功能与规范地位的背离,阻碍了法院会议纪要充分发挥其应有作用。欲弥合这种背离,应重新认识法院会议纪要的性质,立足于我国司法现实语境思考其制度定位。
The minutes of the meeting formulated and issued by the people’s court belong to the judicial guidance documents,which can only be used to help the judge to demonstrate the reasons for the judgment according to the provisions.However,the functional analysis of such documents as the minutes of the national court bankruptcy trial work meeting and the minutes of the national court civil and commercial trial work meeting in judicial practice shows that the minutes of the court meeting has actually become an important judicial basis for judges.There is a certain degree of deviation between the actual function of court minutes and the status of norms.This is mainly caused by the abstraction and lag of legislation,the administration of the power structure within the judiciary,and the reality of the contents of the minutes of the meeting.The deviation between the actual function and the normative status hinders the court meeting minutes to give full play to its due role.In order to close this deviation,we should re understand the nature of the minutes of court meeting,and think about its system positioning based on the context of judicial reality in China.
