摘要
卫星导航系统为各行业和人们生产生活提供必不可少的定位、导航和授时服务,服务于国家安全和经济社会发展。导航信号是卫星导航系统运行的必备要素,应通过法律制度强化对导航信号的保护。然而当前保护制度的特殊性、有效性和强制性不足,难以有效防范侵害导航信号行为的发生,归根结底是法律制度的演进滞后于社会的发展。我们应当在认识和尊重卫星导航系统重要作用和发展规律以及无线电信号自身属性的情况下完善导航信号保护制度。在频率的划分和使用上优先确保北斗系统频率;在优化外防信号干扰机制的同时着眼于自身抗干扰能力制度建设;在对侵害行为和损害后果分级分类的基础上确保责任相称,以发挥法律责任预防侵害导航信号的行为、救济被侵害的合法权利的作用。
Satellite navigation system provides essential positioning,navigation and timing services for industries and people’s production and life,serving national security and economic and social development.Navigation signal is an essential element of satellite navigation system.This requires the legal system to strengthen the protection of navigation signals.However,the current protection system is limited to its particularity,effectiveness,and lack of compulsion,and cannot prevent the occurrence of violations of the navigation signal.This shows that the evolution of the legal system has lagged behind the development of society.To improve the signal protection system of the satellite navigation system,it is necessary to understand and respect the important role and development law of the satellite navigation system,as well as the attributes of the radio signal itself.First of all,give priority to protecting the frequency demand and safety of the BDS.Secondly,while optimizing the external signal interference prevention mechanism,it also focuses on the establishment of its own anti-interference ability system.Thirdly,to play the role of legal responsibility in preventing violations of the navigation signal and remedying the infringed legal rights,the violations and the consequences of damage should be classified to ensure proportionate responsibilities.
