摘要
作为未来管理资源(价值)有效配置和流通的重要技术,区块链应用对现行社会管理制度已然产生全方位、多层次的冲击与影响。反观围绕区块链技术的现有法律分析多侧重于以加密货币和金融钱包为典型的应用监管,而对该技术在隐私和个人信息保护领域的探讨则相对较少,这显然与当前以个人数据为驱动核心的数字经济发展态势相脱节。欧盟《一般数据保护条例》以"个人相关性"和"个人指向性"双重标准构建而成的个人数据保护体系在区块链下个人信息安全风险防控方面表现出良好的灵活性和兼容性。借鉴欧盟《一般数据保护条例》的规制路径并结合我国立法现状,我国应建立区块链信息服务提供者分类责任体系,以妥善平衡技术创新风险与个人数据保护之间的紧张关系。
Being a significant management technology for the effective allocation and circulation of resources(value)in the future,the application of blockchain has already imposed all-round and multi-level impacts on the existing social management system.In contrast,the current law research with regard to blockchain technology mostly focuses on the legal supervision of its application in cryptocurrency and financial wallets,while few discussions are devoted to the risk it may cause to the protection of privacy and personal information.This is obviously out of line with the current development trend of the data-driven digital economy.The personal data protection system constructed under the EU General Data Protection Regulation based on the double standards of"personal relevance"and"personal orientation"shows excellent flexibility and compatibility in preventing and controlling personal information security crisis under the blockchain environment.In consideration of both the regulation path of the EU General Data Protection Regulation and our current legislation status,a classification liability system is suggested to be established for blockchain information service providers to properly balance the tension between technological innovation risks and personal information protection.
