法律关系视角的“依法治考”研究

Research on Law-based Administration of Examinationfrom Perspective of Legal Relationship

摘要 依法治考是教育治理现代化的重要内容,受到各方关注,关于依法治考的学术研究呈现出发展性、阶段性和薄弱性的整体特征,基于此,在界定国家教育考试、依法治考、国家教育考试立法等核心概念的基础上,以法律关系为视角对教育考试法律关系开展研究,是依法治考研究的基本理论思路与研究逻辑,具有发展导向与创新引领的学术价值。 As an important part of the modernization of education governance,the law-based administration of examination has attracted the attention of all parties.Previous academic research on the law-based administration is still in the beginning phase,comparatively weak,thus in need of further exploration.Such being the case,the present study strongly suggest that future research attach more importance to the legal relationship oflaw-based administration of exams,with the explanation of the key terms like national education examination,law-based administration of exam,and legislation of national education examination,etc.In this way,the relative studies will be of more academic value.
