摘要
人工智能时代,侵犯公民个人信息犯罪发生新的变化:涉案信息数量增加指数化、个人信息追踪精准化、侵犯手段多样化。以犯罪情境为视角,结合此类犯罪情境形成的主客观条件,分析犯罪情境与侵犯公民个人信息犯罪生成的关系。可以通过减少犯罪情境形成的客观因素、减少走入犯罪情境的个体数量、增加可感知的犯罪风险三类预防措施来减少侵犯公民个人信息犯罪。
In the era of artificial intelligence,the crime of infringing on personal information has undergone a new change:the amount of information involved in the case has increased exponentially,personal information tracking has become more accurate,and the means of infringement have been diversified.From the perspective of criminal situation,combined with the subjective and objective conditions of such criminal situation,the relationship between criminal situation and the generation of the crime of infringing personal information was analyzed.It is reasonable to reduce crime of infringing on personal information by reducing the objective factors of criminal situation,reducing the number of individuals entering criminal situation and increasing the perceived risk of crime.
