摘要
社区矫正工作中存在一些认知误区:将行政执法权、行政管理权与行刑权混同,导致监督管理措施“刑罚化”;以用警不畅、“执法需要”为借口,自行组建所谓的社区矫正执法队伍,导致社区矫正队伍建设的“警务化”;要求管理过程的“无缝对接”和“无盲点”,片面追求“工作要求的过程精致主义”,导致社区矫正管理过程的“精致化”等。针对这些问题,必须正确认知社区矫正的法律定位,树立社区矫正工作新理念,破除社区矫正工作中的威权观念和惩罚观念,明晰监督管理的边界,贯彻落实监督管理的适度性原则,明确社区矫正的核心任务,克服教育管理中的教条主义,制定包容性的社会政策,化解社会排斥因素,营造宽容性的社区文化氛围。
There are some cognitive misunderstandings in the community correction work:the administrative law enforcement power,the administrative management power and the execution power are confused,resulting in the“punishment”of the supervision and management measures;The so-called community correction law enforcement team is set up under the pretext of difficult use of police and“law enforcement needs”,which leads to the“policing”of the construction of community correction team;It requires“seamless connection”and“no blind spots”in the management process,and one-sided pursuit of“process refinement of work requirements”,which leads to“refinement”of the community correction management process.In view of these problems,we must correctly understand the legal orientation of community correction,establish a new concept of community correction work,break away from the authoritarian and punitive concepts in community correction work,clarify the boundaries of supervision and management,implement the principle of moderation of supervision and management,clarify the core task of community correction,overcome dogmatism in education management,formulate inclusive social policies,resolve social exclusion factors,and create a tolerant community cultural atmosphere.
