摘要
2010年公安部对《公安机关涉案枪支弹药性能鉴定工作的规定》进行了修订,确定了枪支枪口比动能1.8焦耳/平方厘米的枪支鉴定标准,此后对涉枪类犯罪中以压缩气体为动力的玩具枪、仿真枪的刑事认定一直存在争议,赵春华案就是其中最为典型的代表。基于此,最高人民法院、最高人民检察院于2018年出台了《关于涉以压缩气体为动力的枪支、气枪铅弹刑事案件定罪量刑问题的批复》(以下简称《批复》),对存在的涉枪类犯罪中的司法实务难题及审查裁判要旨进行了针对性的修正、解释及引导,取得了积极的实践效果。但《批复》依旧存在定义范围不明确,认定标准较为模糊,具体裁判存在适用尺度不一致等问题,仍需不断完善。
In 2010 the Public Security Organs Regulations of the Guns Performance Appraisal Work Involved in the Case were revised by the Ministry of Public Security,which determines the gun muzzle kinetic energy 1.8 joule per square centimeter of guns appraisal standard,then in gun crime powered by compressed gas in the toy gun,imitation guns criminal cognizance has been controversial,which is one of the most typical representative on case,Zhao Chunhua case has been widely criticized by the society.Based on this,In 2018,the Supreme People’s Court and the Supreme People’s Procuratorate issued the Reply on the Conviction and Sentencing of Criminal Cases Involving Guns and Lead Bullets of Air Guns Powered by Compressed Gas(hereinafter referred to as the Reply),which specifically amended,explained and guided the existing problems in judicial practice and the gist of examination and judgment in gun-related crimes,and achieved positive practical effects.However,the“Reply”still has some problems,such as unclear definition scope,fuzzy identification standard and inconsistent application scale of specific judgment,which still need to be improved.
