摘要
在国际经济竞争日趋激烈,国内经济处于结构调整、转型升级的大背景下,我国不良资产市场规模也在不断增长,近两年来一直保持在较高水平上,且呈现稳步增长态势。同时,伴随着金融科技的飞速发展,互联网不良资产处置新模式逐步落地成熟。当前有四种不同形式的互联网不良资产处置模式,本文通过分析每种模式的实现路径,以不良资产网络拍卖平台模式为研究对象,探究其内在法律关系,进而分析我国互联网不良资产处置的法律规制存在的不足之处,最后从立法修法、明确责任分配和健全买受人权益保护机制三个方面提出建议。
In recent years, with the severe competition of international economy, the domestic economic growth has been adjusting the structure and upgrading the industry resulting in the steady increase of the non-performing assets. At the same time, with the rapid development of Fintech, new forms for the disposal of non-performing assets on the Internet have matured. Currently, there are four different forms of disposal of Internet non-performing assets. This article analyzes the path of each form and take the online auction platform for non-performing assets as the research object to explore the internal legal relationship and analyze the existing shortcomings of disposal of non-performing assets on the Internet of China. Finally, this article puts forward suggestions in terms of legislative amendments, assignment of responsibility and sound protection of the rights and interests of the buyer.
