摘要
数字经济全球化趋势不断凸显,而数据作为数字经济最基本、最关键的生产要素,必然随着经济全球化跨境流动。如何依法加强数据跨境监管并确保其安全,文中通过比较分析美国和欧盟两大经济体的立法模式选择、具体规则设计和权利义务平衡,对我国在该领域的立法现状进行深入剖析,旨在为我国进一步完善数据跨境流动监管措施提供有针对性的借鉴和参考,以保障国家数据主权、统筹数字经济发展与安全。
The trend of digital economy globalization is becoming increasingly prominent,and data,as the most basic and critical production factor of digital economy,will inevitably flow across borders with economic globalization.How to strengthen the cross-border supervision of data and ensure its security ac-cording to law,by comparing and analyzing the legislative model selection,specific rule design and bal-ance of rights and obligations of the two major economies of the United States and the European Union,this paper makes an in-depth analysis of China's legislative status in this field,aiming to provide targeted reference for China to further improve the supervision measures of cross-border data flows,so as to ensure national data sovereignty and coordinate the development and security of the digital economy.
