摘要
太行地区异常困顿的生活导致许多家庭的婚姻关系紧张。中共在太行根据地一度以实现解放妇女、婚姻自由为切入点对广大女性开展动员,边区系列婚姻法规的颁布进一步给广大女性提供了维护自身利益的法律依据和实现路径,导致这一时期太行根据地内产生大量婚姻纠纷,进而影响到根据地的稳定和各项工作的开展。在司法实践中,各级组织、团体尽量保持婚姻家庭的稳定及维护为革命作出更多贡献者的利益,使大量婚姻纠纷采用调解的方式得以化解。就晋冀鲁豫边区相关婚姻法规的颁行以及“妇女解放”等理念的宣传而言,其象征意义远大于实际意义,根据地诸多女性“婚姻自由”的目标远未实现,但大量婚姻纠纷的出现却对根据地的传统男权提出了挑战,客观上提高了根据地女性的家庭、社会地位。
With the extremely difficult and harsh life,many troubles rose in marriages in Taihang revolutionary base.The Communist Party of China once mobilized the majority of women in order to achieve the liberation of women and freedom of marriage.The promulgation of a series of marriage laws and regulations in the border region further provided the legal basis and approaches for women to secure their own interests,resulting in a large number of marriage disputes during this period,which interfered with the effective operation and the stability of the revolutionary base.In judicial practice,organizations at all levels tried their best to maintain the stability of marriages and ensure the interests of those who had made more contribution to the revolution,and a large number of marriage disputes were resolved by mediation.The significance lay much greater in symbolic sense than in practical sense in terms of the promulgation of the relevant marriage laws and regulations and the propaganda of the concept of"Woman Liberation"in the border region of Shanxi,Hebei,Shandong and Henan.Far from achieved was the goal of"freedom of marriage"of many women in the revolutionary base.However,the emergence of so many marriage disputes has challenged the traditional patriarchy and actually improved the domestic and social status of women in the revolutionary base.
