摘要
司法具有服务乡村社会治理、推进建立健全现代乡村社会治理体制、助力打造充满活力及和谐有序的善治乡村的积极作用。江西省寻乌县人民法院大力弘扬毛泽东寻乌调查的"唯实求真"精神,促进乡村治理中自治、法治、德治的有机结合,逐渐形成了"联村共治、法润乡风"的"寻乌经验"。寻乌县人民法院积极履行司法职能,保障村民自治、促进社会治理、弘扬文明乡风、推进乡村善治,服务国家乡村振兴战略。在健全乡村治理体系方面,寻乌县人民法院通过广泛利用社会力量、依法确认调解协议、积极认可良善习惯、全力融入地方社会等方法,参与乡村社会治理,推进乡村社会的法治建设,促进乡村振兴。在推进乡村治理体系健全过程中,寻乌县人民法院依照法律规定,主要通过立足审判、着重调解、发布规范性文件和典型案例、进行普法宣传等形式,健全自治、法治、德治相结合的乡村治理体系。
Judicature plays an active role in serving rural social governance,promoting the establishment and perfection of modern rural social governance system,and helping to build a dynamic and harmonious and orderly good governance of rural areas.The Court of Xunwu County in Jiangxi Province vigorously carried forward Mao Zedong’s spirit of seeking truth in his researching toward Xunwu County,promoted the organic combination of autonomy,rule of law and rule of morality in rural governance,and gradually formed the"experience of Xunwu"of"jointly governing villages and ruling villages by law".The Court of Xunwu County has actively performed its judicial function,guaranteed villagers’autonomy,promoting social governance,promoting the civilization of countryside,promoting good governance in rural areas,and serving the strategy of revitalizing the country’s villages.In improving the rural governance system,the Court of Xunwu County has participated in rural social governance,as well as promoted the construction of the rule of law in rural society and promoted the revitalization of rural areas by making extensive use of social forces,confirming mediation agreements in accordance with the law,actively recognizing good habits,fully integrating into local society,and so on.In the process of promoting the improvement of the rural governance system,the Court of Xunwu County,in accordance with the provisions of the law,mainly through had trial based on the law,emphasized mediation,issued normative documents and typical cases,publicized the law popularization and other forms,to improve the rural governance system which consists of autonomy,ruled by law,as well as ruled by morality.
