摘要
法律理念是法律知识的范导性规则。在一般情况下,法律知识受这些理念的引导,而正义是道德价值体系中的核心理念之一。在法律职业活动中,正义的关系是法律职业中的一个主要问题。法律职业伦理规范是指导和规范法律职业者职业活动的行为准则,它是社会和国家对法律职业者行为和关系的基本要求的概括。法律职业伦理规范是法律职业伦理基本准则的具体化。相较于传统的法律规制,法律职业伦理规范及其执行机制有着自身的特点。以善恶正邪的社会现象作为考察对象是伦理学科的定向事实。所谓伦理,可以划分为个人伦理与社会伦理两个方面,而早期的伦理学还是一种个人伦理学,它对个人行为有更多的关心,而较少关注社会和政治制度的完善。正义即社会正义,正义即“符合道德”。当人们问一个社会是不是正义的,就等于在问,一个社会是不是符合道德的;如果问一个人及其行为是否符合道德,则一般不用是否“正义”回答,而用另外的字眼,如“正直”“正当”,乃至“公正”等。
Legal ideas are the guiding rules of legal knowledge,and generally legal knowledge is guided by these ideas.Justice is one of the core conceptions in the moral value system.In professional activities,the relationship of integrity or justice is a major issue in the legal profession.The ethical norms of legal profession are norms of conduct that guide and regulate the professional activities of legal professionals.They are summaries of the basic requirements of society and state for the behavior and relationship of legal professionals.The ethical norms of legal profession are the embodiment of the basic principles of legal professional ethics.Compared with the traditional legal regulation,legal professional ethics and its implementation mechanism have their own characteristics.It is a directional fact of ethics to take the social phenomena of good and evil as the object of ethical investigation.When we try our best to cultivate legal science,we neglect ethics,especially the part of legal professional ethics.The so-called ethics can be divided into two aspects:personal ethics and social ethics.However,the early ethics was still a kind of personal ethics,which paid more attention to personal behavior,while less attention to the improvement of social and political systems.Justice is social justice and it means abiding by morality.When we ask whether a society is just,we are asking whether the society is moral.If we ask whether a person and his behavior are moral,we don't use“justice”,but other words,such as“integrity”,“legitimacy”and even“fairness”.
