摘要
法治是人类共同创造的文明成果,党的十五大提出依法治国方略后,我国法治向现代转型,市场经济体制建立对民族法建设提出新的要求,民族法治是以科学完备的民族法律体系为基础,解决民族问题的社会有序状态。传统法学中民族法处于宪法的次部门法地位,目前民族法律体系初步形成,使其成为独立的法律部门。民族法形成区域自治法为主干的结构体系,市场经济下加强民族法建设非常重要。本文研究概述民族法建设理论,分析市场经济对民族法建设的影响,提出基于市场经济的民族法建设策略。
The rule of law is the civilization achievements created by all mankind.The 15th National Congress of the Communist Party of China(CPC)put forward the basic strategy of enforcing the law.And the building of market economic system has made a new quest for the construction of ethnic law.Based on the scientific and complete ethnic law system,ethnic rule of law can solve ethnic problems and safeguard the state of social order.In the context of traditional law,ethnic law is at the position of the sub-department law of the Constitution.At present,ethnic law system has been initially formed,so it has been an independent legal department.Considering the structural system of ethnic law,regional autonomy law acts as the main body.So it is important to strengthen the construction of ethnic law under the background of market economy.The paper expounded the construction theory of ethnic law,analyzed the impact of market economy on ethnic law construction,and finally proposed countermeasures.
