摘要
资源供给是长三角生态绿色一体化发展示范区建设的关键环节,对法治保障的需求较高。当前其相关任务面临着“制度供给过剩”“制度供给不足”等难题构成的法治困境,该困境的成因是多维度全方位的,有纵向和横向的法治悖论。破解该法治困境,需要采取并坚持“事权法治制度一体化”“立改废释并举”等方略,从而为发展示范区建设提供更有效的法治保障。
Resource supply is a key point in the construction of the demonstration zone of green and integrated ecological development of the Yangtze River Delta,which need high-qualified legal protection.At present,there is a legal dilemma,consisting of“excessive legal supply”and“insufficient legal supply”.The cause of the dilemma includes both vertical and horizontal paradox of the rule of law.To solve this legal dilemma,we should implement and stick to targeted strategies,such as“power-rule of lawsystem-incorporation”and“upholding,legislation,reform,abolishment and interpretation”,so as to provide effective legal protection.
