The core legal issue in the Ulysseas,Inc v.The Republic of Ecuador case concerns whether the actions of the Consejo Nacional de Electricidad(CONELEC)can be attributed to Ecuador,affecting the determination of the arbitral tribunal’s jurisdiction and the assumption of state responsibility.The interim award in the case ruled that the arbitral tribunal has the jurisdiction and briefly analyzed the issue of the state attribution.In the final award of the case,the Arbitral Tribunal determined that CONELEC’s actions cannot be attributed to Ecuador.The arbitral tribunal also elucidated the legal origins of state attribution rules and proposed criteria,differentiating between contractual actions and sovereign actions,to determine the attribution of actions conducted by a specific entity within the public sector to a state.International investment arbitration resolves disputes where a host state’s international wrongful act harms investor’s interests.A prerequisite for initiating this remedy procedure is that the act must be committed by the host state,i.e.,actions of the host state’s entities can be attributed to the host state.State attribution rules in the international investment law system continue to evolving,and the comprehensive reasoning of the final award of this case can serve as a precedent for subsequent international investment arbitration practices.
