合法占屋:巴西的住房运动、公民身份和“城市权利”

摘要 20世纪70年代中期以来,权利本位的城市社会运动迅速增多,但我们对其实际影响的理解仍不充分。以圣保罗住房运动为例,本文阐述了权利本位路径的优势和限度。本文认为圣保罗住房运动应该在两个对立进程并存的全球背景下加以理解:新自由主义城市化和权利本位的社会运动。尽管权利本位路径未能为巴西不平等的住房分配带来根本性的变革,但它为住房运动提供了新的法律和制度化手段。这为其行为提供了合法性并影响了政策过程,从而增强了运动的韧性并扩大了其规模。本文指出,应允权利和实际权利之间的差距为促进集体动员、挑战新自由主义和推动新的公民身份概念提供了政治机会。 Rights-based urban social movements have proliferated since the mid-1970s,but our understanding of their real impacts remains insufficient.Using the housing movements in São Paulo as an example,the article demonstrates both the limits and the strengths of the rights-based approach.It argues that housing movements in São Paulo must be understood in the global context of the coexistence of two contradictory trajectories:the neoliberal urbanism and the rights-based movements.While the rights-based approach has yet to bring fundamental changes to the unequal housing distribution in Brazil,it provides the housing movements with new legal and institutional devices to justify their actions and influence the policy process,thus contributing to the unusual resilience and scale of the movements.The article reveals that the gap between rights promised and rights delivered can be utilized as a political opportunity for facilitating collective mobilization,contesting neoliberalism,and advancing new conceptions of citizenship.
