摘要
《中华人民共和国商标法》第五十六条、第五十七条对注册商标的权利范围从“行”与“禁”两个方面进行了规定。商标的权利范围是相对的,具有模糊性、可变性、延展性及受限性的特点。在实践中,商标权利范围的大小取决于经营者对商标的使用情况以及由此形成的显著性和知名度的大小。混淆理论及其背后蕴含的竞争政策是理论和实践中把握商标权利范围的核心理论。在商标注册制度改革中,商标权利范围的界定和把握应体现尊重使用、鼓励注册的保护政策,对不同商标视其是否注册、是否驰名以及影响力大小推行有区分的保护。
Article 56 and 57 of the Trademark Law of the Peop le's Republic of Chinastipulate the scope of rights of a registered trademark from two aspects:“use”and“prohibition of use”.The scope of trademark rights is relative,showing the characteristics of fuzziness,variability,extensibility and limitation.In practice,the scope of trademark rights depends on the use of trademarks by trademark operators and the degree of distinctiveness and brand awareness.The confusion theory and the competition policy behind it is the core theory to define the scope of trademark rights in theory and practice.In the reform of the trademark registration system,the scope of trademark rights should be defined around the trademark registration system,reflecting the protection policies of encouraging trademark registration and respecting the use of trademark,and different protection levels,protection intensity and protection areas should be carried out for different trademarks depending on whether they are registered,well-known or influential.
