摘要
在2016年修订的《民办教育促进法》确定对民办学校按照营利性、非营利性实行分类管理后,如何保障非营利性民办学校的法人财产权、实现学校自主管理,成为一个政策难点。现阶段,以基金会为办学主体,可以实现出资人与非营利性民办学校之间的财产隔离,确保办学的自主化和社会化,前提是建立严密的监管制度。为此,建议加快实现教育全行业属地管理,对非营利性民办学校、公办学校统一按照"非营利法人"机构进行管理,鼓励非营利性民办学校积极探索现代学校制度以及适宜的教师薪酬、社会保障和激励制度。
The Non-governmental Education Promotion Law, revised in 2016, determines that non-governmental education institutions should be managed according to their for-profit and non-profit categories, and thus how to protect the juridical person property rights of non-profit non-governmental education institutions and realize their independent management has become a policy difficulty. At this stage, with the foundation as the main body of running institutions, properties between the funders and the non-profit non-governmental education institutions can be isolated so the institutions’ autonomy and socialization can be ensured, though the premise is to establish a strict supervision system. Thus, it is recommended to speed up the implementation of territorial management of the entire education system, uniformly manage non-profit non-governmental education institutions and public education institutions in accordance with the "non-profit juridical person" organization, and encourage non-profit non-governmental education institutions to actively explore the modern education system with appropriate staff pay, and social guarantee and incentive systems.
