摘要
运用案例分析和文献资料法,在姓名权、商标权性质、特征及其相互关系研究的基础上,对姓名权和商标权冲突发生的原因进行分析,提出了解决冲突的可沟通途径,最后强调企业应当强化法制观念和诚信经营,并指出可行性解决方案,给予了相关建议。
Research on quality and characters of famous sportsmens rights of name and right of trademark was made by means of case analysis and literature mathematical statistics. It is about conflict of trademark and name right. On bases of legal definition in trademark and name right,reasons for conflict with trademark and name right was studied,and feasible solutions to these problems were put forward. The last,strengthen legal institutions and honest management for company was announced through analysis of the practical case,possible solutions and suggestions are then discussed.
