摘要
在数字劳工平台企业用工“去劳动关系化”趋势下,具备一定从属性的平台劳务提供者难以被认定为从属性劳动者,其劳动法保护陷入困境。当平台劳务提供者以独立承包人的身份与平台企业达成用工合同时,平台用工关系作为经济活动中经营者间的交易关系,应当属于反垄断法规制对象。反垄断法介入平台用工关系具备现实必要、理论基础和规范依据。分析数字劳工平台企业的市场力量和用工行为可知,平台企业对平台劳务提供者的用工“控制”涉嫌构成滥用市场优势地位行为,但为平衡平台劳务提供者保护和平台经济发展之价值冲突,应当审慎对数字劳工平台企业实施反垄断处罚。
Under“de-labor relations”in the digital labor platform,it is difficult for the platform labor service providers with certain subordination attributes to be recognized as subordinate employees,its labour-law protections are in trouble.When the platform labor service provider reaches a contract with platform enterprise as an independent contractor,the contract relationship,as a trade relationship between the operators in the economic activities,ought to be regulated by Antitrust law.It is necessary for Antitrust Law to regulate platform labor relations,along with theories and statutory basis.According to the analysis of market power and behavior of digital labor platform enterprises,the“control”behavior of platform enterprises is suspected to constitute abusing of market dominant position.In order to balance the conflict between the protection of platform labor service providers and the development of the platform economy,the Antitrust Law punishment to the digital labor platform enterprises should be applied prudently.
