摘要
美国数字经济反垄断转向的趋势较为明显。本文通过对美国数字经济领域垄断行为及数字经济反垄断法案的研究后发现:美国数字经济领域反垄断的转向,是美国反垄断法律理念转变、遏制平台权力扩张及民众支持的综合结果。对于中国而言,美国数字经济领域反垄断转向的做法具有一定的借鉴意义,应在明确数字经济反垄断主体规制模式基础上,保持反垄断的法治化及理性轨道,加强反垄断与常态化监管的衔接。
It is relatively obvious to see the trend of anti-monopoly in the digital economy of America.By studying the monopoly behaviors in the digital economy field of America and the anti-monopoly act of the digital economy in this thesis,it is found that the comprehensive results such as the change of the legal concept of anti-monopoly in America,the containment of the expansion of platform power and public support cause the shift of anti-monopoly in the field of the digital economy of America.In terms of China,the practice of shift to anti-monopoly in the field of digital economy of America embodies the reference significance to a certain extent.Based on the clarification of the regulation mode of the anti-monopoly subject in the digital economy,the rule of law and rational track of anti-monopoly should be kept,and the connection between anti-monopoly and normal supervision should be enhanced.
