摘要
国际犯罪由国际组织来执法将是国际法治的崭新现象。海盗作为国际公认的普遍管辖的犯罪,成为国际机构执法的首要对象应是自然之常理。近十年来国际社会反海盗的实践也已证明了这一点。反海盗国际刑警组织作为政府间国际组织,构建它的法律依据其实已在相关公约中通过“所有国家”“国际合作”“抓捕和扣押海盗(船)”的规定得到体现。虽然现已具备较坚实的法律和政治基础,但是也有一定的风险和障碍。这些风险和障碍可以在客观形势转变、主观能动努力的条件下加以防范和克服。总体而言,构建该组织具有可行性。我国作为海洋大国和经济较强国家,也作为“人类命运共同体”和“一带一路”构想的提出者,在建立该类组织中可扮演倡导者和驱动者的角色。
International organizations enforcing law to international crimes is new circumstance in international law rule.As an internationally-recognized crime,piracy being primary object of international institution enforcement is axiom of nature.Last decade,anti-piracy practice of international community has proved it.Anti-piracy international police organization being inter-governmental organization,legal basis of its establishment has been reflected by provisions—“all nations”“international co-operation”“arrest and detain piracy(ship)”of related convention.And its establishment has laid solid law and political foundation.Yet its establishment has certain ventures and obstacles.These ventures and obstacles would be kept away and overcome under the condition of changed objective circumstance and subjective effort.Hence,in general,its establishment is feasible.Since our country is maritime and economical great power,and provider of concept of“community with shared future for mankind”and“the belt—the road”,it should play the role of pioneer and driver in establishment of the international organization.
