摘要
国家民事执行威慑机制是我国为了综合治理解决执行难问题而探索建立的一项新的工作机制与法制机制,它通过对被执行人的生产经营、社会生活乃至名誉、人身自由的严格限制和严厉制裁,造成强大的社会威慑效应,迫使被执行人履行生效法律文书确定的义务。建立国家民事执行威慑机制具有现实必要性。国家民事执行威慑机制正处于初创时期,需要从各方面加以完善。
The national civil execution deterrent mechanism is a new working mechanism and the legal system mechanism for our country to solve the problem of difficulty of execution. It produces powerful social deterrent effect and force debtor to fulfill duties definited by effective legal document through the strict limit and strict sanction of management, social life, reputation and personal freedom of the debtor. The establishment of national civil execution deterrent mechanism has the realistic necessity. The national civil execution deterrent mechanism is being in the newly established time, needs to improve from various aspects.
