摘要
在“执行难”成为民事执行之痼疾的今天,仅仅把眼光局限于司法系统之内似乎已经不能满足实践的需要。完善协助执行人制度对于缓解“执行难”、保障民事执行工作的顺利进行和弥补司法之不足有着重要的意义。在具体建构协助执行人制度中,协助执行人的范围、协助执行人加入诉讼的方式和协助执行人的权利义务责任是主要的内容和核心环节。审慎的制度设计对于发挥协助执行人的功能,实现协助执行人之立法目的有着决定性的作用。
It is held in the paper that to perfect auxiliary marshal system in China will help resolve the difficulty in civil judgment enforcement, ensuring trouble-free execution. For this purpose, it＇s necessary to discuss the concept, function, range and other areas of the auxiliary marshal system in detail. In constructing the aux- iliary marshal system, the range, obligations and duties of the auxiliary marshal together with how they will assist should be the ibcus and main contents, as these play a key role in realizing the function of the auxiliary marshal and achieving the goal of legislation.
