摘要
由于证明责任机理的存在 ,证明标准呈现出多元化和层次性。从证明责任的角度对刑事证明标准进行分析 ,不同证明责任承担主体、在不同的诉讼阶段、针对不同的证明对象履行证明责任所需达到的证明标准也不相同 ,具有层次性。
Because the mechanism of burden of proof exists, the standard of proof presents plurality and gradations. Analysis on the criminal proof standards from the angle of burden of proof shows that the proof standards are different and possesses gradations to different subjects presuming burden of proof, in different proceeding stages, and to different proof objects.
