The Foreign Experience and Chinese Thinking on Incorporation of Treaties into the Constitution

摘要国际条约作为国际法的主要渊源,是有效构建和维护国际秩序的法律工具。条约缔结、条约效力与条约适用构成条约制度的重要内容。条约制度的良好运行离不开国际法与国内法的相互配合,宪法承担着调整国际法与国内法关系的重要功能。各当事国理应由其宪法规定条约制度,以便从根本上避免国际条约在国内实施的混乱。纵观条约入宪的域外立法,因受到传统国际法与国内法关系理论的影响,条约入宪模式在一元论与二元论之间呈现出不同的变化形式。随着中国不断深入参与全球治理,条约入宪成为协调国内法治与涉外法治的关键枢纽,我国在构建条约入宪体系时应突破传统理论桎梏,以协调论为指导赋予条约低于宪法高于法律的国内法效力,重新划分公法条约与私法条约各自的适用方式,不断契合中国法治需求,为中国的国际法治奠定坚实基础。 As the main source of international law,international treaties are legal tools for effectively building and maintaining the international order.The conclusion,validity and application of treaties are important elements on constituting the treaty system.The good operation of the treaty system is inseparable from cooperation between international law and domestic law.The constitution has an important function of adjusting the relationship between international law and domestic law.The treaty system should be stipulated in their constitutions in order to fundamentally avoid confusion in the domestic implementation of international treaties.Throughout the extraterritorial legislation of treaties into constitution,due to the influence of the traditional theory of the relationship between international law and domestic law,the model of treaties into constitution shows different forms of change between the monism and the dualism.With China’s continuous in-depth participation in global governance,treaty into constitution has become a key hub for harmonizing the rule of law at home and foreign-related rule of law.When building the system of treaty into constitution,China should break through the shackles of traditional theories,give treaties with effectiveness in domestic law that is lower than the constitution and higher than the law,and redivide the application methods between public law treaties and private law treaties,and constantly meets the needs of China’s rule of law and lays a solid foundation for China’s international rule of law.
