摘要
在认罪认罚制度全面推行语境下,围绕谅解主体、谅解自愿性和合法性、谅解范围等三个要素,考察434个涉及被害人谅解的认罪认罚裁判样本,并对样本来源地区S省R市的6位刑事审判人员开展半结构化访谈,结果显示,被害人谅解有效性认定存在三个问题,一是在普遍比较注重协商格局下,部分案件中参与谅解的主体过多且参与时机有误,二是在确认式庭审背景下,部分法官对谅解自愿性和合法性审查不够严谨、合理,三是部分法官随意运用自由裁量权,无故突破个案中的谅解范围。对此,应从适当规制谅解参与的主体和时机、加强谅解自愿性和合法性的审查力度、准确认定被害人谅解的范围等路径求解。
In the context of fully implementing the system of giving leniency for pleading guilty and accepting penalty(PGAP)?,focusing on the three elements of victim's understanding,the subject of understanding,the willingness and legality of understanding,and the scope of understanding,we counted 434 judgment samples of the system of PGAP,which involving the victim's understanding.Additionally,we conducted semi-structured interviews with six criminal adjudicators in R City,Province S,where the samples came from.Our findings revealed three problems in determining the validity of the victim's understanding.Firstly,in a strong negotiation pattern,there are too many subjects participating in proceedings and the timing of participation is incorrect.Secondly,in some cases,the review of the voluntary and legality is not rigorous and reasonable enough.Finally,a small number of judges have exceeded the scope of understanding in individual cases by using their discretion in an unreasonable manner.Therefore,it should be solved from the ways of appropriately regulating the subject and timing of participation,strengthening the review of the voluntary and legality of victim's understanding,and accurately determining the scope of victims'understanding.
